Merchant Reward Opportunity Terms

All capitalized terms shall have the meaning ascribed to them in the Merchant Agreement.

In connection with Merchant’s Loyalty Program and the opportunity of a Program Participant to earn Points that may be redeemed for Rewards, Merchant shall comply with the following:

Merchant Reward terms shall be disclosed to Program Participants in compliance with applicable laws, and shall, at a minimum, include:

• how Rewards/Points can be redeemed

• Reward/Points expiration, ensuring such expiration periods are in conformance with state law minimum expiration periods as verified by Merchant.

• how Rewards/Points are earned/received

Merchant shall comply with, and shall disclose to Program Participants in a clear and conspicuous manner, the following:

• Points shall not be assigned a specified cash/dollar value

• Points shall be non-transferable

• Points cannot be purchased with cash

• Points shall have no cash value and cannot be redeemed for cash

• Merchant shall inform Program Participants of any material changes to terms related to Rewards and Points in advance of such changes.
